Remuneration: US$ 4,400/month. Each month’s pay will be subject to the satisfactory accomplishment of the corresponding chapter of the report that constitutes the object of the contract. The last of the payments will be condition that the final draft of the report contains the observations made by the Executive Secretary of the IACHR.

Place of employment: country of residence.

Duties and responsibilities: Preparation of a “Thematic Report on the Situation of Justice Operators in the Americas” that will include concrete recommendations on the matter for the State members of the Organization of the American States (OAS). For the fulfillment of the object the consultant will have to carry out the following activities:

a. To prepare, in consultation with the Executive Secretary, the conceptual approximation that the term ‘justice operator’ would have with the effect of preparing the report.

b. To work on a questionnaire to distribute among state members and civil society with the objective of gathering information for the report.

c. To compile and to systematize information on the standards of International Law with special emphasis on the Inter?American system, on the matter of impartiality and independence of justice operators.

d. To gather information of normative character on the obstacles to ensure the independence and impartiality of the justice operators in the states members of the OAS. To systematize and describe the main types of weaknesses and obstacles identified and to exemplify them using the compiled information.

e. To collect information on the factual weaknesses and obstacles that condition the impartiality and independence of justice operators in the Americas. To systematize and describe the main types of weaknesses and obstacles identified and to exemplify them using the information put together.

f. To complete a final report on the situation of justice operators with the product of the above mentioned activities and to prepare conclusions and recommendations pertinent to the state members of the OAS.

g. To include to the final product the inputs and observations that could be carried out by the Executive Secretary of the IACHR and the rapporteur on Human Right Defenders.

The property of the products that will be obtained in the frame of this project is exclusive to the Inter-American Commission on Human Rights.

Requirements:

Lawyer with graduate or doctorate studies completed, expert in comparative constitutional law with knowledge of International Human Right law and with published work in the subject of independence and impartiality of justice operators. Knowledge of English and Spanish.

Remuneración: US$ 4.400 por mes. El pago de cada mes estará supeditado a la entrega satisfactoria del capítulo respectivo del informe que constituye el objeto del contrato. El último de los pagos estará condicionado a que el borrador final de informe contenga las observaciones realizadas por la Secretaría Ejecutiva de la CIDH y tenga su aprobación definitiva.

Deberes y Responsabilidades:

Elaboración de un Informe temático sobre la Situación de las y los Operadores/as de Justicia en las Américas que incluirá recomendaciones concretas en la materia para los Estados miembros de la Organización de Estados Americanos (OEA). Para el cumplimiento de dicho objeto el/la Consultor/a deberá cumplir las siguientes actividades:

a. Elaborar en consulta con el equipo de la Secretaría Ejecutiva la aproximación conceptual que tendría el término operador de justicia a efectos de la elaboración del informe.

b. Elaborar un cuestionario para su distribución a los Estados y a la sociedad civil con el objetivo de recopilar información para el informe.

c. Recopilar y sistematizar información sobre los estándares de derecho internacional, con especial énfasis del sistema interamericano, en materia de independencia e imparcialidad

de las y los operadores de justicia.

d. Recopilar información sobre los obstáculos de carácter normativo para asegurar la independencia e imparcialidad de las y los operadores de justicia en los Estados parte de la

OEA. Sistematizar y describir los principales tipos de debilidades y obstáculos identificados y ejemplificarlos utilizando la información recopilada.

e. Recopilar información sobre las debilidades y obstáculos de carácter fáctico que condicionan la imparcialidad e independencia de las y los operadores de justicia en las Américas.

f. Completar un informe final sobre la situación de las operadores y operadores de justicia con los productos de las anteriores actividades y elaborar las conclusiones y recomendaciones

pertinentes a los Estados miembros de la OEA.

g. Incluir al producto final los insumos y observaciones que pudieran ser realizadas por la Secretaría Ejecutiva de la CIDH y el Relator de Defensoras y Defensores. La propiedad de los productos que se obtengan en el marco de este proyecto es exclusiva de la Comisión Interamericana de Derechos Humanos.

Requerimientos:

Abogado/a con estudios de maestría o doctorado concluidos, experto/a en derecho constitucional comparado con conocimientos de derecho internacional de los derechos humanos y obra publicada en materia de independencia e imparcialidad de los operadores de justicia. Conocimiento de inglés y español.
